What is a Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal document that allows you to choose trusted people to make decisions on your behalf if you lose mental capacity. It ensures your wishes are respected and your trusted Attorneys can act without lengthy court processes.
Property and Financial Affairs
Manage your bank accounts, pay bills, manage property, and handle investments
Health and Welfare
Make decisions about medical treatment, care arrangements, and daily routine
Why choosing the right Attorneys matters
Trust and reliability
Your Attorneys will have significant power over your affairs and welfare. Choose people who understand your values and will act in your best interests.
Understanding your wishes
The right Attorneys know your preferences for care, treatment, and how you want your money managed. They can make decisions that align with your values.
Capability and availability
Your Attorneys need the time, ability, and willingness to take on this responsibility. We help you assess whether your chosen people are suitable.
Common considerations
- Should you appoint one Attorney or multiple?
- What if your first choice cannot act?
- How should multiple Attorneys make decisions?
- What restrictions or guidance should you include?
We help you think through these questions and make informed choices.
Why you should act now
Many people delay creating an LPA, thinking they have plenty of time. But accidents and illness can happen at any age.
Accidents happen
A sudden accident, stroke, or diagnosis can leave you unable to make decisions overnight. Without an LPA in place, your family faces months of legal processes and uncertainty.
Creating an LPA while you have capacity gives you control and protects your loved ones from unnecessary stress.
Recommended from age 18
The Office of Public Guardian recommends everyone over 18 should have an LPA. Young adults face risks from accidents, sports injuries, and unexpected health issues.
Starting early means you have protection throughout your life, and you can update your LPA as your circumstances change.

Important scenarios to consider
Understanding these critical situations highlights why professional guidance and timely action are essential for your Lasting Power of Attorney Documents.
When it's too late
Once you lose mental capacity, you can no longer create an LPA. Your family will need to apply for a Deputyship through the Court of Protection—a lengthy, expensive, and stressful process that can take 7-9 months and cost thousands of pounds.

Common misunderstandings
Many people believe their spouse or children automatically have the right to manage their affairs. This is not true. Without an LPA, even your closest family members have no legal authority to access your bank accounts, manage your property, or make healthcare decisions on your behalf.

High rejection rates
The Office of Public Guardian rejects approximately 1 in 5 LPA applications due to errors in completion. Common mistakes include incorrect signatures, missing information, or misunderstanding legal requirements. Professional guidance significantly reduces rejection risk.

Why Make a Will?
A Will ensures your wishes are carried out after your death and gives you control over who inherits your Estate. Without one, the law decides who benefits – which may not reflect your intentions.
Making a Will can help you:
- Protect your spouse, partner, and children
- Ensure unmarried partners are provided for
- Appoint guardians for your children
- Provide for children from previous relationships
- Help reduce delays and complications with Probate
- Minimise potential Inheritance Tax liabilities
- Reduce the risk of family disputes and uncertainty
Without a valid Will, your loved ones could face unnecessary stress, delays, and financial uncertainty at an already difficult time.

LEF & Co founded by Mother and Daughter Paula and Lydia. Two professionals with a shared passion for helping people protect their future and support their families.
Lydia
At 18, Lydia experienced two life-changing losses, her Nan and her childhood best friend. Neither of whom had a Lasting Power of Attorney in place. The experience inspired her passion for helping others protect themselves and their families for the future.
After studying at the University of Nottingham and building a successful career in sales, Lydia moved into Wills and Estate Planning in 2023.
Today, she is passionate about educating people on the importance of Wills, Lasting Power of Attorney, and Estate Planning, especially from a young age, as unexpected illness or accidents can happen to anyone.
Paula
Paula has spent over 30 years building businesses, developing brands, and supporting business owners as a coach. Through both her professional and personal experiences, she has seen the serious impact unexpected illness, accidents, or emergencies can have when LPA’s are not in place.
For the past 8 years, Paula has also acted as Attorney for her father following complex neurological health conditions, giving her firsthand insight into the emotional and practical responsibilities involved.
Passionate about protecting families and businesses, Paula helps clients put the right plans in place to safeguard their future. Through LEF & Co, she also provides dedicated support for Attorneys. Both professionally and emotionally, helping people navigate the journey with confidence and clarity.
